legal standing as defendant Explanation: It is almost certainly legitimación pasiva, or legal standing as defendent. The judgment throws out the defence that there is no title to utility model and says references to LP are meaningless because this is not an intellectual property action but unfair competition and there is clearly LA as claimant is affected by it. This seems to make perfect sense to me. -------------------------------------------------- Note added at 22 mins (2011-01-06 10:45:23 GMT) -------------------------------------------------- Rebecca may well be right. It could equally refer to Patents Act which would make just as much sense. |

Patents Act (Ley de Patentes) Explanation: You will know if this fits from the rest of the context provided in your text, which appears to indicate that the remedy sought would fall under the provisions of the Unfair Competition Act (Ley de Competencia Desleal) rather than under the Patents Act. -------------------------------------------------- Note added at 42 mins (2011-01-06 11:05:22 GMT) -------------------------------------------------- The text appears to indicate that since the party in question has not registered his "envase monodosis" as a utility model and has no license therefor at the Spanish Patent and Trademark Office (OEPM), it is inappropriate to bring an action for infringement of industrial property rights ("no se articula acción de protección de tales derechos de propiedad industrial") and, thus, references to the Patents Law in his pleadings are meaningless ("referencias a la LP efectuadas en la contestación carecen de sentido").
