(heritable) building right entry Explanation: On the basis of Kim's entry it seems to me that this is similar to the German law concept of Erbbaurecht (see all the KudoZ entries on that term). I don't know if the Austrian concept is heritable, but the suggestion that 2 - 3 generations can benefit points in that direction. My experience of Austrian real estate law is that "einlage" is an entry or possibly a charge. |

Reference: Info Reference information: So wie der Erwerb und das Bauen auf eigenem Grund und Boden genau gesetzlich geregelt ist, gilt für das Bauen auf fremdem Grund das Baurechtsgesetz. Erst mit der Baurechts-Novelle 1990 wurde die Baurechtseinräumung Privatpersonen gestattet, früher war es Vorrecht von Gemeinden, Städten, Klöstern und Kirchen. Zur rechtlichen Absicherung des Baurechtsvertrages - seine Dauer beträgt 10 bis 100 Jahre - wird im Grundbuch eine eigene Baurechtseinlage angelegt um so den Baurechtsnehmer und dessen Rechtsnachfolger optimal zu schützen. Der Grundstückseigentümer überlässt dem Bauherrn eine bestimmte Bauparzelle langfristig zur Nutzung und bekommt dafür als Gegenleistung den Baurechtszins. Neben den gesetzlichen Vorschriften werden viele Details im Baurechtsvertrag im beidseitigen Einvernehmen festgelegt. Der Baurechtsvertrag erstreckt sich im Wohnbereich über 2 - 3 Generationen und kann daher nur von einem Fachmann (Notar oder Anwalt) errichtet und verbüchert werden. Die Grundverkehrsbehörde muss ihre Zustimmung erteilen und das Finanzamt kassiert die Grunderwerbssteuer. Mehr über das Baurecht und wichtige Fragen hiezu, finden Sie auf den nächsten Seiten. Dieses bücherliche Recht ist im Grundbuch im Lastenblatt (C-Blatt) des Grundstücksbesitzers eingetragen. In der Folge wird eine eigene Baurechtseinlage (mit eigener Einlagezahl) eröffnet. Reference: Some references re Austrian real estate in English (translation) Reference information: The Land Register is consists of the general ledger (Hauptbuch) and archives (Urkundensammlung). The general ledger contains a Land Register enclosure (Grundbuchseinlage) for each piece of real estate, including its lot number (Einlagezahl, EZ). Each enclosure contains three parts (folios): A folio (Gutbestandsblatt), which has two sections: A1, identifying the lot number, its size and use; A2, setting out the rights and encumbrances relating to the real estate (such as easements, write-offs, public restrictions and burdens). B folio (Eigentumsblatt), containing ownership details. C folio (Lastenblatt), showing encumbrances on the real estate, in particular mortgages, easements, burdens, and prohibitions against sale or encumbrances. Building right (Baurecht).
