I am translating a data protection policy and having trouble with this sentence:

"Das BSDG erlaubt die Datenverarbeitung und -nutzung stets, wenn dies im Rahmen der Zweckbestimmung eines Vertragsverhältnisses oder vertragsähnlichen Vertrauensverhältnisses geschieht oder soweit es zur Wahrung berechtigter Interessen der speichernden Stelle erforderlich ist und kein Grund zu der Annahme besteht, dass das schutzwürdige Interesse des Betroffenen *****an dem Ausschluss der Verarbeitung oder Nutzung überwiegt."*****

I am wondering how to translate the last portion of this sentence. I'm not sure how to interpret the phrase "an dem Ausschluss...überwiegt." Thank you for your help!
