Explanation:
He encontrado dos textos de medicina legal en los que queda bien claro el sentido. Se trataría de que los datos empíricos son mal evaluados, dando lugar a una decisión errónea. No se trata de un error de la percepción, sino de la evaluación de esa percepción.
Es cierto que "IN the face of" = contra, frente a algo. Pero aquí es "ON the face of the evidence", y esta expresión es propia de la medicina jurídica. No se trata, pues, de que, contra la evidencia, se haya tomado una decisión errónea sino de que, como decía, una mala apreciación de la evidencia ha llevado a una tal decisión.

Creo que lo importante es que son errores evidentes, pues esta última cita dice "clearly", y la anterior traía en negrita "absolutely clear".

Por eso yo diría "un error evidente en la apreciación de la prueba"... muy parecido a lo que propone la compañera, pero lo propongo como respuesta independiente porque agrego un concepto (de "evidente, muy claro, indiscutible") que me parece fundamental.

No es un error de apreciación cualquiera sino que uno que "salta a la vista".

Post-grading: Respeto muchísimo la decisión de Romina y las contribuciones de los colegas.

Pero en el contexto, estamos hablando de casos como, por ejemplo, que en el expediente de una persona se agregó información respecto a otra persona, etc. No se entró a valorar la prueba... se vio de plano que las cosas estaban mal.

Retrospectivamente, tal vez se pudo hablar de una apreciación "prima facie" de la prueba... error que surge de una apreciación prima facie de la prueba...
