In applying Article 85 an English contract, one may have to consider whether, after the excisions required by the Article of the Treaty have been made from the contract, the contract could be said to fail for want of consideration or on any other ground, or whether the contract may be so changed in its character as not to be the sort of contract the parties intended to enter at all.

disagree  AstritIsm: Neadekvatno. Ovo je situacija kada stranke nemaju interesa/volje za razmenu dobara/usluga iz proste nezelje da se pozabave s prirodom proizvoda/usluga, a ne zato sto naknada nedostaje. Prosto, radi se o tome kad ti neko kaze "ne zanima me". No offence.
