From Perú:

On Tuesday, January 12, the last Hearing at the Superior Court of Lima was held, with regard to the claim filed by Luz del Sur and Ede-Cañete against the Commission of Electric Tariffs (CTE).

As it will be recalled, the electricity companies, after going through all the administrative instances, filed this claim as they considered that the CTE had not applied the Law correctly, when setting the New Replacement Value (VNR) with which the distributions tariffs were set in November, 1997.

Eugenio Araya, General Manager of Luz del Sur, said that the current economic situation of the country is understood, and that this claim had been filed in order not to hypothecate the future of the company, as the future tariff settings -which as provided by Law have to be made every 4 years- similarly to that of November, 1997, would put the company in a risk position and consequently, the electric supply, of vital importance for the progress of the country, would not be guaranteed.

Therefore, in the event that the Court´s decision would favor the complainant companies and the CTE would calculate again the VNR leading to an increase in the distribution tariffs, Luz del Sur has stated that it has renounced to the tariffs increase, as it is more a matter of how the law must be applied, rather than the number resulting from such an application. If the Court´s decision is against the complainants, the tariffs setting would be going backwards to non-technical criteria considerations, thus risking the future of the electric sector.
