I am translating a contrat and after the presentation of the parties it reads "witness that" then carries on on the following line with "whereas etc.. the Parties hereto mutually agree as follows:"
What is the meaning of "witness that" in this context, 'prendre pour témoin'? I have never come across this expression in contracts before.

Witness that = witnesseth

Peut également se traduire par "Préambule".

Il est préférable de réserver "attendu que" aux décisions de justice et de ne pas l'employer dans les préambules des contrats en français.

La formule "Il est préalablement exposé / rappelé que" englobe la traduction de "witness that " et "whereas".
