The Lease provides that the Landlord will deal with the day to day maintenance and repair of the main structure of the building.
In return, a service charge is collected which will fluctuate from year to year, depending on the actual expenditure involved.

The managing agents XXX have only recently taken over the management of the building and therefore they indicate that the service charge accounts for 2008 still need to be issued. We have suggested to the Seller's solicitors that **the retention is made to cover any excess service charge due from the Seller pending issue of the year end accounts.**

Non capisco molto bene il significato dell'ultima frase (dopo ho finito... ultima domanda!!)

"L'agenzia immobiliare XXX ha iniziato solo recentemente ad occuparsi della gestione dell'edificio; pertanto, dichiara che i bilanci relativi alle spese di gestione per il 2008 devono ancora essere redatti. Abbiamo consigliato ai legali del Venditore di optare per la trattenuta (DA RIVEDERE...) a copertura di eventuali eccedenze delle spese di gestione dovute dal Venditore così come emergeranno dai bilanci di fine anno, ancora da definire.
SONO COMPLETAMENTE FUORI STRADA?...

Per iil periodo completo suggerirei:
Abbiamo consigliato ai legali del Venditore di effettuare l'accantonamento a copertura di qualsiasi possibile/eventuale eccedenza delle spese di gestione a carico del Venditore in conseguenza della futura emissione definitiva dei bilanci di fine anno (ancora da definire, ovviamente, ma serve dirlo?).
