Ich habe hier ein Problem mit einem ganzen Satz aus der Bestimmung, in der festgelegt wird, in welchen Fällen der Verkäufer nicht für einen Gewährleistungsfall haftet:
Any liability of the Seller shall be excluded :
(g) to the extent to which the Warranty Event ***liability items including but not limited to liabilities and accruals have been allocated and/or provided for*** or depreciations including but not limited to exceptional depreciations and depreciations to reflect lower market values have been made in the Balance Sheet.
Und hier liegt das Problem im eingesternten Teil des Satzes. Der Verkäufer haftet nicht für Verbindlichkeiten aus dem Gewährleistungsfall, für die Rückstellungen gebildet wurden? Aber was ist dann mit den accruals? Bin für jeden Tipp dankbar!
