Господа, как Вы переводите данное выражение? Согласно нашему ГК неустойка бывает 2х видов: пени и штраф. Штраф устанавливается в виде однократно взыскиваемой суммы, тогда как пени назначается в качестве меры обеспечения против длящегося нарушения и соответственно пропорционально кол-ву дней, в течение которых имеет место нарушение. А есть ли в англ.языке аналоги?Заранее благодарю за участие

Explanation:
In many international Contracts equal to Russian “неустойка в виде пени» согласно ГК. I researched this question for quite some time now, and according to Black’s Law Dictionary – in this case scenario Parties has no necessity to go to court, unless they have to, due to non-payment and they do not have a need to prove in court actual damages sustained.

Asker: Thank you for your help, however based on what I found, liquidated damages is a FIXED sum of satisfaction for the violation of a contract. http://www.lectlaw.com/def/l045.htm. Seems like a forfeiture is a better English analog for Russian неустойка

Asker: compensation or damages go on top of the penalty...it is a different thing in the Russian civil law. So in case of a contract breach the injured Party is entitled to get both

agree  Dorene Cornwell: I would probably use just damages or compensation in the form of a fine a penalty and then translate the definition as provided in the text. My first instinct was penalty in the form of a fine or penalty; this variant is much better style.
