The German could IMO have been written a teensy-weensy bit more understandably with the "überhaupt" following "Anwartschaften beider Ehegatten"; as it is, I think the underlying meaning has been missed.

I read it as implying that there MAY be no need for the "unterschiedlich hohe Anwartschaften" to be "ausgeglichen", and would therefore suggest:

"If it is (in fact/ at all / in practice) necessary to...", which includes the force of the "überhaupt".
