Die verfassungsrechtlichen Garantien des Mietrechts resultieren aus der allgemeinen Norm, die der Art. 64 Abs. 1 und 2 der Verfassung bildet. Das Mietrecht ist nämlich eines der Sachrechte, die dem „für alle gleichen”, mit derselben Norm wie der Eigentumsschutz statuierten Rechtsschutz unterliegen. Aufgrund der Rechtsprechung des Verfassungsgerichtshofes und der Auffassung der Lehre besteht auch kein Zweifel darüber, daß der Art. 21 Abs. 1 der Verfassung, der verkündet, daß „die Republik Polen das Eigentum schützt”, sich nicht nur auf das Eigentumsrecht im Sinne des Zivilgesetzbuches (Bürgerlichen Gesetzbuches), sondern auch auf alle Vermögensrechte und somit auch auf das Mietrecht bezieht.

Nie zazdroszczę tego wyboru. W języku n. istnieją rzeczywiście 2 różne pojęcia: Sachrecht (prawo materialne) i Sachenrecht (prawo rzeczowe), i bardzo trudno tu ocenić na podstawie podawanych definicji, które ze znaczeń lepiej pasuje. Zwracam jednak uwagę, że w tekście źródłowym wyraźnie stoi "Sachrechte".

W języku n. istnieją rzeczywiście 2 różne pojęcia: Sachrecht (prawo materialne) i Sachenrecht (prawo rzeczowe), i bardzo trudno tu ocenić na podstawie podawanych definicji, które ze znaczeń lepiej pasuje. Zwracam jednak uwagę, że w tekście źródłowym wyraźnie stoi "Sachrechte".

agree  Mateusz Wawrzyniak: sprawa jest tu prosta, bo "Mietrecht" nie jest prawem rzeczowym. A "Sachrecht" i "Sachenrecht" absolutnie nie są wyrazami bliskoznacznymi tylko dwoma różnymi terminami prawniczymi!
