As súmulas vinculante (CF 103-A) e impeditiva de recursos (CPC 518 § 1.°), bem como a possibilidade de o relator não conhecer de recurso (juízo de admissibilidade) ou negar-lhe provimento (juízo de mérito) que contrarie súmula da jurisprudência predominante no próprio tribunal ou em tribunal superior (CPC 557 caput), são mecanismos que reforçam a idéia que vimos apresentando neste estudo, de que os tribunais superiores têm extrema responsabilidade ao proferir suas decisões, porque elas fazem parte integrante do Richterrecht, sejam proferidas em processos objetivos com eficácia erga omnes (e.g. ADIn), sejam em processos subjetivos com eficácia inter partes (e.g. RE, REsp e RR).
