U Vašem konkretnom slučaju, s obzirom na to "basis" nije bio dio pitanja kojeg ste postavili, evo i dopune. Smisao cijele rečenice je zapravo sljedeći:

Sud je odlučio da Tuženik isplati Tužitelju troškove kojima je bio izložen u ovom postupku na osnovi troškova stranke koja se zastupa sama, koji će (dakle ti troškovi) biti procijenjeni ukoliko ne mogu biti usuglašeni, to jest ukoliko se ne postigne dogovor oko iznosa tih troškova.
