还有一些人，由于种种原因，搞出发明后自己并不想申请专利权。例如，他也许无力或无意支付专利申请费以及每年的维持费。在这种情况下，他也许会把发明卖给别人，让别人去申请专利。一项专利在无人购买其使用权之前是赔钱货。只有当别人购买专利使用权 (license to use the patent)时，它才赚钱。有不少人说“我公司购买了美国某某专利”，实际上只是购买了使用权，并非专利权本身。不少专利直至失效都无人问津。

在 "work for hire" 的情况下，雇员把专利申请权转让给公司也是合理的，因为他是利用公司的资源搞出发明的。当然，公司也会给予一定的奖励。

是的，这份文件已经把可能的专利权也转让出去了。Inventor 可以把专利申请权转让给别人，在某些情况下还必须转让，例如在work for hire的情况下。很多公司在录用雇员时，都会在雇用合同里规定，如果该雇员将来有所发明，必须将专利申请权转让给雇主。将来专利权批下之后，专利权就不属于 Inventor，而属于assignee。你若查一下美国专利，就会发现，很多专利里会写明，Inventor是谁，assignee是谁，而assignee往往是以公司出现。

我不明白的是为什么要把专利申请权跟专利权分开说。其实可能是不分割的，没有人只要专利申请权不要专利权。因为这个 file wrapper 里面只有一个申请权宣誓书，说把“申请权转让给XXX”，我在想是不是这份文件已经把专利权也转让出去了。当然还有一个可能是，因为专利权在专利被批准时才成立（至少台湾法律如此），可能要等到那个时候才谈得上专利权的转让。当然，这只是我作为非律师的猜测而已。 :-)
