see explanation Explanation: What it literally means is this: Termination shall come into effect one month after notice has been sent / served, in the event that no response has been received. I am not sure if 'unsuccessful' is enough to convey this concept - after all, an unsuccessful notice could be one that is lost in the post!!! -------------------------------------------------- Note added at 1 day12 hrs (2007-10-07 20:48:16 GMT) -------------------------------------------------- Having dug around in some past jobs of mine, here is one way of putting it, which may be helpful: 'In the event that a [default] notice served on {here you could add the details, usually it is simply the other party/parties - the defaulting party/parties} remains unanswered one month after being sent, the contract shall be terminated' . - or you could say 'termination shall come into effect' - although it all means pretty much the same thing! It must be one of the most awkward clauses - impossible to render it neatly in English, as Tony says! |
