En caso de no cumplir el “Afianzado” con sus obligaciones contractuales estipuladas en el referido Contrato, esta Fianza será exigible y la Compañía se obliga a pagar al Dueño, dentro de los treinta (30) días de comprobado el incumplimiento, la cantidad de dinero equivalente a las obras que el Afianzado no hubiere concluido conforme las voces del Contrato y hasta un monto que no exceda la Suma Afianzada, la cual es el límite de responsabilidad de la Compañía con base en esta Fianza. La Compañía podrá cumplir su obligación optando por la ejecución del Contrato, bien sea usando los servicios del Afianzado o de otras personas, respetando siempre las voces del Contrato.
