Raczej w tym kierunku.

Chodzi o to, że zgodnie z polskim prawem to co na gruncie (trwale związane) przynależy do gruntu (zasada superficies solo cedit). Innymi słowy, kiedy kupujemy dom, to w sensie prawnym zazwyczaj kupujemy grunt pod tym domem.

Jest jednak kategoria tzw. nieruchomości budynkowej, albo lokalowej. Wtedy dla budynku / lokalu zakłada się odrębną księgę wieczystą i traktuje ją jako odrębną nieruchomość. Moim zdaniem tu ma miejsce właśnie taka sytuacja.

Explanation:
(na jednym z lokalnych warsztatów TEPIS "przerabiana" byłe księga wieczysta - stąd tez w/w termin)
Das Sondereigentum wird in § 5 WEG definiert. Man kann daher vereinfacht sagen, dass Sondereigentum alles innerhalb der jeweiligen Wohnung beziehungsweise Einheit ist, was nicht zwingend gemeinschaftliches Eigentum darstellt. Demnach gehören alle Teile des Gebäudes die für dessen Bestand oder Sicherheit erforderlich sind zum Gemeinschaftseigentum . Hier zählen z.B. tragende Wände, Wasserzähler und konstruktive Gebäudeteile dazu. Aber auch die Abdichtung und die Wände des Balkons gehören zum Gemeinschaftseigentum , hier kann jeweils nur der Fliesenbelag zum Sondereigentum zählen. Es sollte auch in Abänderung zum § 5 WEG die Teilungserklärung und Gemeinschaftsordnung und die jeweilige aktuelle Rechtsprechung befragt werden, da sich hier im Einzelfall auch was anderes ergeben kann.
