sm. nizhe Explanation: It doesn't necessarily have to be a criminal case. Pleading can also be making assertions in the complaint filed by Plaintiff. Some causes of action require the Plaintiff to allege that Defendant had actual knowledge (scienter), as opposed to having been only negligent or reckless. For example, usually a Defendant can be found liable for hitting somebody with a car if he was merely reckless or careless, whereas fraud generally requires the higher standard of actual knowledge. In terms of a Russian phrase I haven't a clue, but maybe something like ссылаться детально, что ответчик действовал заведомо. The answer may have to be made up out of whole cloth based on the concept. |
