право на компенсацию реальных убыток и упущенной выгоды Explanation: Reliance damages and expectation damages are 2 different ways of calculating damages in American tort law. Reliance damages are meant to put the victim in the same position they would have been had there never been a contract (money spent in advance, etc.) Expectation damages give the innocent party what they would have had if the contract had been performed, including lost profits (упущенная выгода). Sometimes they will be the same amount; other times not. An innocent party may also sometimes get reliance damages even if the court finds there was no contract at all. -------------------------------------------------- Note added at 2 days17 hrs (2006-07-11 00:15:57 GMT) -------------------------------------------------- Expectation damages does not 100% = упущенная выгода. There are sometimes adjustments since innocent party cannot come out *better* than without the contract. Any Russian lawyers out there have the exact term? |
