legal proceedings initiated by the victim/private individual (under private law) Explanation: Private law varētu vietējai sistēmai arī neatbilst, tāpēc sliecos uz deskriptīvu tulkojumu atbilstoši kriminālprocesa likumam: 7.pants. Publiskā un privātā apsūdzība (1) Ja šajā likumā nav noteikts citādi, kriminālprocesu veic sabiedrības interesēs neatkarīgi no tās personas gribas, kurai nodarīts kaitējums. Šāds kriminālprocess ir publiskās apsūdzības kriminālprocess, kurā apsūdzības funkciju valsts vārdā īsteno prokurors. (2) Par Krimināllikuma 90., 130.pantā (ar vardarbību ģimenē saistītos gadījumos), 131., 132., 136., 145.pantā, 159. un 160.panta pirmajā daļā, 168., 169., 180., 197.pantā, 200. un 260.panta pirmajā daļā paredzēto nodarījumu publiskās apsūdzības kriminālprocesu uzsāk, ja saņemts pieteikums no personas, kurai nodarīts kaitējums. (3) Par Krimināllikuma 130.pantā (izņemot ar vardarbību ģimenē saistītus gadījumus), 156., 157. un 158.pantā paredzēto nodarījumu tiek veikts privātās apsūdzības kriminālprocess, kurā apsūdzības funkciju īsteno cietušais. Private law is that part of a legal system which is part of the jus commune that involves relationships between individuals, such as the law of contracts or torts, as it is called in the common law, and the law of obligations as it is called in civilian legal systems. It is to be distinguished from public law, which deals with relationships between natural and artificial persons (i.e., individuals, business entities, non-profit organizations) and the state including regulatory statutes, penal law and other law that effects the public order. In general terms, public law involves interrelations between the state and the general population, whereas private law involves interactions between private citizens. The concept of private law in common law countries is a little more broad, in that it also encompasses private relationships between governments and private individuals or other entities. That is, relationships between governments and individuals based on the law of contract or torts are governed by private law, and are not considered to be within the scope of public law. |

private (criminal) complaint Explanation: Private Criminal Complaint This form is to be used by private citizens when requesting criminal charges be filed against a defendant. http://www.aopc.org/Index/Forms/IndexForms.asp Viss tomēr ir atkarīgs arī no tā, par kuru valsti ir runa. Visa frāze: criminal proceedings in cases initiated by private complainants Latviski: Kuros gadījumos var iesniegt privātsūdzību? Par Krimināllikuma 90., 130.pantā (ar vardarbību ģimenē saistītos gadījumos), 131., 132., 136., 145.pantā, 159. un 160.panta pirmajā daļā, 168., 169., 180., 197.pantā, 200. un 260.panta pirmajā daļā paredzēto nodarījumu publiskās apsūdzības kriminālprocesu uzsāk, ja saņemts pieteikums no personas, kurai nodarīts kaitējums. Par Krimināllikuma 130.pantā (izņemot ar vardarbību ģimenē saistītus gadījumus), 156., 157. un 158.pantā paredzēto nodarījumu tiek veikts privātās apsūdzības kriminālprocess, kurā apsūdzības funkciju īsteno cietušais. Kriminālprocesu privātās apsūdzības lietā var uzsākt tikai tad, kad persona, kurai radīts kaitējums, iesniegusi tiesai sūdzību par konkrētu personu par noziedzīga nodarījuma izdarīšanu. The complaint is a written statement of the essential facts constituting the offense charged. Thus, we conclude that private citizens should submit their criminal complaints to the prosecuting attorney for evaluation or to the appropriate law enforcement agency for investigation before such complaints are presented to the magistrate for a probable cause determination. We emphasize that the evaluation of private citizen criminal complaints by a prosecuting attorney or the investigation of such complaints by a law enforcement agency before presenting such complaints to a magistrate shall in no way affect the judicial function to be performed by the magistrate in making a probable cause determination. In a few jurisdictions a private party may institute criminal proceedings without the authorization or approval of the prosecuting attorney.
