I am chosing this answer because of the wording used; however, Femme's answer is equally correct, as what I finally figured out is that when the defendant opposes a claim (that is, presents his defenses and exceptions) the plaintiff has a change to reply and challenge the exceptions (that is make a "REJOINDER" o "COUNTERCLAIM". In this case, the petitioner did not reply to the defendant's exceptions; therefore, a rejoinder/counterclaim (dúplica) was not allowed. Thanks to both. A pity that we cannot divide the points
