This appears at the top of a Supreme Court appeal for reversal (recurso de casación) of a judgment handed down by a lower court. I know "procedencia" means appropriateness or origin, and that the appellant is claiming that the judgment was inappropriate or incorrect, but is there a translation for "Procedimiento de procedencia"?

Rather than a request for appeal from a decision on the merits, I believe this refers to a specific stage in cassation appeal procedure defined below (Diccionario de Derecho Bosch, Barcelona, 1995), but ("solo por curiosidad) could you please indicate whether the document (judgment?) in question is dated prior to Jan. 1, 2000?? (This could affect the translation, since that's the date that the "new" Spanish Civil Procedure Act went into effect, and the procedure for granting leave to proceed in cassation appeals is slightly different.)

SUSTANCIACIÓN DEL RECURSO DE CASACIÓN-Es la fase del procedimiento de casación que se desarrolla a continuación de la interposición del recurso. Se inicia la misma con el dictamen del fiscal, que se pronunciará sobre la procedencia o improcedencia del recurso o de alguno de sus motivos. Seguidamente, las actuaciones se pasarán al magistrado ponente, para que se instruya y someta a deliberación del tribunal lo que haya de resolverse. David, there are three steps, the "Preparación del recurso" (art. 479), "Resolución sobre la preparación del recurso" (Art. 480) and "Decisión sobre la admision del recurso" (Art 483). The two former steps are procedures before the court that issued the decision under appeal, and involve ruling as to whether the appeal meets the criteria for cassation proceedings. The latter ("Decisión sobre la admisión del recurso-Art. 483) takes place when the formal "interposición del recurso" has been filed before that court (Art. 481) and the "autos" have been transferred to the TC (Remisión de los autos-Art. 482). Without more context from your doc I can't say whether this refers to the "preparación" stage or the "admisión" stage, but here is a link where you can read these articles for yourself:

If from the context of your document this actually refers to the first stage ("preparación del recurso") in which the appellant has to convince the court that issued the decision that the appeal meets the requisites for appeal in cassation (Art. 479), then you might translate "procedimiento de procedencia" as "procedure requesting leave to appeal" (or if it's for UK audiences "permission" to appeal, since I understand that "leave" was replaced with "permission" after the Lord Woolf reform).
