En Derecho de Familia habría que comenzar sentando qué es familia o si se prefiere, qué concepto de familia sirve de base o sustento para la organización jurídica destinada a protegerla. Las dificultades no son pocas teniendo en cuenta que no existe, en nuestro Derecho, un concepto constitucional de familia.

Consecuencia de lo anterior es la necesidad de iniciar el trabajo con la intención de descubrir dónde puede encontrarse el concepto de familia siendo conscientes de que la propia legislación (el propio legislador constitucional) ha renunciado a definirlo. Ello nos obliga, por tanto, a encontrar los medios necesarios para obtener un concepto de familia que se adecue a las distintas ideologías (***por concepto*** inamovibles) así como a los distintos avatares sociales y culturales (por esencia cambiantes).
