Wenn der Bauunternehmer in Konkurs geht, sind bei Baufehlern die Gewährleistungsansprüche des Bauherrn nutzlos. Dieses Risiko sichert die Gewährleistungsbürgschaft einer Bank ab. Deshalb sollte der Bauunternehmer im Bauvertrag verpflichtet werden, eine entsprechende Bankbürgschaft beizubringen.

Cos mi sie wydaje, ze taki rodzaj poreczenia istnieje raczej na ziemi niemieckiej, dlatego moja propozycja jest kombinacja, na ktora nie daje gwarancji:)
